1. Introduction

Welcome to ECUDesk (“Company,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our software and website. By purchasing, downloading, or using our software, you agree to these Terms.

2. Company Information

  • Authorized Global Reseller / Merchant of Record: ProTune Performance PTY LTD, Cape Town, South Africa (Representative: Liam Novitzkas).

  • Note: Some payments may be processed by ProTune Performance PTY LTD as an authorized reseller and Merchant of Record.

3. Description of Services

ECUDesk provides a specialized data-editing platform for automotive ECU firmware modifications and diagnostic error code analysis.

  • Professional Tool: The software is an engineering tool intended for use by qualified professionals only.

4. Intended Use and Regulatory Compliance

  • Research and Racing Only: The software is designed and intended exclusively for research, diagnostic, or competitive racing/off-road use.

  • Compliance with Emissions Laws: Modification of vehicle emissions systems (e.g., DPF, EGR, or Catalyst removal) may be illegal in certain jurisdictions (such as US EPA or EU Euro standards).

  • User Responsibility: It is the sole responsibility of the User to ensure that any modifications comply with local environmental, traffic, and safety regulations.

  • No Commercial Modification Service: We do not encourage or endorse the use of our software for illegal vehicle modifications on public roads.

5. Licensing & Restrictions

A personal, non-transferable software license is granted. Prohibited:

  • Reverse engineering, decompiling, or disassembling the software.

  • Reselling or transferring licenses without authorization.

  • Usage for illegal purposes or in violation of local laws.

6. Payments & Refund Policy

  • Payments may be processed via invoicing, bank transfers, or through our authorized reseller ProTune Performance PTY LTD.

  • Refunds: Available within 14 days only if the license has not been activated, or if the user has processed no more than 3 files for testing and technical issues could not be resolved.

  • No automatic renewals; all renewals are manual.

7. Limitation of Liability

P/E Rychkov Aleksandr and ProTune Performance PTY LTD shall not be held liable for:

  • Damage to vehicle hardware, ECU components, or data loss.

  • Legal repercussions, fines, or penalties incurred by the User for violating local emissions or road safety laws.

  • Indirect, incidental, or consequential damages.

  • The User assumes 100% of the risk associated with vehicle tuning and firmware modification.

8. Privacy & Data Collection

We collect personal and technical data as described in our Privacy Policy. Analytics data may be shared with trusted third-party providers, including Google.

9. International Sales

ECUDesk is sold worldwide where legally permitted. Users must ensure compliance with their local laws before purchasing.

10. Referral & Partnership Program

A commission (typically $200-300 USD per sale) applies to successful referrals. To participate, the referrer must own an active ECUDesk license.

11. Changes to Terms

We may update these Terms periodically. Changes take effect once posted on our website.
